Family Educational Rights and Privacy Act (FERPA)

U.S. federal law protecting the privacy of student education records at any institution that receives federal funding.

Definition

In long form.

FERPA gives parents (and students once they reach 18) rights over their education records: the right to inspect, the right to seek amendment, and the right to control disclosure. Education institutions and their vendors must obtain consent before disclosing PII from education records, with limited exceptions. The 'school official' exception is the most common path for vendor access — provided the vendor is under direct control of the institution.

In context

Edtech vendors typically operate under the FERPA 'school official' exception, which requires a data processing agreement specifying that the vendor is acting under direct institutional control and won't use student data for other purposes.
